Agreement to Terms
By downloading, installing, or using Pookey ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
Description of Service
Pookey is a language learning application that provides vocabulary training through games, interactive stories, and spaced repetition learning methods. The service is available as a free version with limited features and a premium subscription with full access.
User Accounts
To access certain features, you may need to create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and current information
- Notifying us immediately of any unauthorized access
Accounts for Users Under 13
Users under 13 years of age must provide a parent or guardian's email address during registration. By providing a parent/guardian email, you confirm that a parent or guardian has consented to the child's use of Pookey. Parents or guardians can contact us at any time to manage or delete their child's account.
Subscriptions and Payments
Premium Subscription
Pookey Premium is available as a monthly ($6.99/month) or yearly ($59.99/year) subscription. All subscriptions include a 7-day free trial for new subscribers.
Billing
- Subscriptions are billed through Apple App Store or Google Play Store
- Payment will be charged to your account upon confirmation of purchase (after the free trial period, if applicable)
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Cancellation
You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the service
- Copy, modify, or distribute App content without permission
- Use automated systems or bots to access the App
- Impersonate others or provide false information
Intellectual Property
All content in Pookey, including but not limited to text, graphics, logos, audio, games, and software, is the property of Pookey and is protected by copyright and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
Disclaimer of Warranties
The App is provided "as is" without warranties of any kind. We do not guarantee that:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or harmful components
- You will achieve specific learning outcomes
Limitation of Liability
To the maximum extent permitted by law, Pookey shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. We will notify users of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new terms.
Termination
We may terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
